In Texas, abortion has been a heavily debated topic for many years. In June of this year, a new law took effect that bans almost all abortions after about six weeks of pregnancy. This law is one of the most restrictive in the country.
So, is abortion legal in Texas? Let’s take a closer look at what this new law says and how it’s been affecting women in Texas.
The new law, known as House Bill 16, makes it a felony to have an abortion after six weeks of pregnancy. The only exceptions are if the mother’s life is in danger or if the fetus has a severe abnormality.
This law has been challenged in court and is currently being reviewed by a federal appeals court. In the meantime, it is still in effect and women who need abortions after six weeks are forced to either go out of state or find other methods.
The Texas Heartbeat Act, Senate Bill 8 (SB 8).
The Texas Heartbeat Act went into effect on Sept. 1 2022 making it illegal for abortion providers to perform the procedure after a fetal heartbeat can be detected.
The law requires abortion providers to use an abdominal ultrasound to determine if a fetal heartbeat is present, and if one is found, the provider must refrain from performing the abortion.
The law includes exceptions for cases of rape, incest, or medical emergency, but does not provide exceptions for cases of fetal abnormality. The law faces several legal challenges and is not currently in effect.
Advocates of the law say it will protect unborn babies, while opponents argue that it is a violation of women’s reproductive rights. It is unclear how the law will ultimately be interpreted by the courts.
Banning Abortion Doesn’t Stop It From Happening
There have been reports of women trying to self-abort with dangerous methods since the law took effect. Unsafe abortions are usually performed by untrained providers using dangerous methods, such as sharp instruments, poisons, or toxic drugs.
These procedures often result in injuries, infection, hemorrhage, and organ damage. In some cases, they can even cause death. Unsafe abortions are a leading cause of maternal mortality in developing countries.
They also have a negative impact on women’s health and well-being. Safe abortion is a fundamental right for every woman, and it is essential to ensuring her health and safety. Unsafe abortions undermines this right and jeopardizes women’s lives.
There is also anecdotal evidence that some women are carrying their pregnancies to term against their will because they cannot get an abortion.
Abortion Access Is First And Foremost a Human Right.
According to a recent study, the number of abortion clinics in Texas has declined by 75% since 2013. This decline has had a disproportionate impact on low-income women, who are often less able to travel long distances to obtain abortion care.
In addition, the cost of abortion care has increased dramatically, making it inaccessible for many women. The result is that abortion access in Texas is now severely limited, and many women are forced to turn to dangerous and illegal methods to terminate their pregnancies.
It’s important to remember that this is just one state, and there are many other states with much more restrictive laws. If this law is upheld, it could set a precedent for other states to follow suit.
